1) Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the My Heritage Life App (the “App”) and related services (the “Service”), operated by Heritage Senior Living, LLC (“we,” “us,” “our”).

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.

2) Authorized use

The App is intended solely for authorized staff, contractors, and approved users acting on behalf of an organization using the Service.

  • You must use the App only for legitimate business and care-related purposes.
  • You may access only the data you are authorized to view.
  • You are responsible for maintaining the confidentiality of your login credentials.

3) Prohibited activities

You agree not to:

  • Access or attempt to access data you are not authorized to view.
  • Use the App for unlawful, abusive, or deceptive purposes.
  • Share login credentials or allow unauthorized access.
  • Copy, scrape, reverse engineer, or attempt to extract source code.
  • Upload malware or attempt to disrupt the Service.
  • Use the App in a way that violates applicable privacy or healthcare laws.

4) Resident and sensitive information

The App may display resident-related content, which may include sensitive personal or health-related information.

  • Such information must be accessed only for legitimate care or operational needs.
  • You must comply with all organizational policies and applicable laws.
  • Unauthorized disclosure or misuse may result in disciplinary action and loss of access.

5) Data ownership

All resident and staff data accessed through the App is owned and controlled by the organization using the Service. We act as a service provider and data processor on behalf of those organizations.

You do not acquire any ownership rights in data accessed through the App.

6) Availability and changes

We strive to keep the App available and reliable but do not guarantee uninterrupted access. The Service may be modified, suspended, or discontinued at any time.

We may update features, functionality, or content without prior notice.

7) Termination of access

We may suspend or terminate your access to the App at any time if:

  • You violate these Terms.
  • Your organization revokes your authorization.
  • Continued access poses a security, legal, or operational risk.

8) Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9) Limitation of liability

To the fullest extent permitted by law, Heritage Senior Living, LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or business opportunities, arising out of or related to your use of the App.

10) Governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

11) Changes to these terms

We may update these Terms from time to time. The effective date above reflects the most current version. Continued use of the App after changes constitutes acceptance of the updated Terms.
